This Privacy Policy applies to all personal information collected by JL & Partners Pty Ltd ACN 642 106 910 (we, us or our) via the website located at www.jlandpartners.com.au (Website) or sheng@jlandpartners.com (Email).
1. What information do we collect?
We collect personal information necessary to provide legal services, verify your identity, comply with our legal and regulatory obligations, and manage our business. Depending on the nature of the matter, we may collect:

- Driver licence, passport or other government-issued identification documents;

- Tax File Number (where authorised or required by law);

- Details of politically exposed person (PEP) status, sanctions screening and adverse media checks where required;

- Any other information voluntarily provided by you or your authorised representatives.
2. Types of information
The Privacy Act 1988 (Cth) (Privacy Act) defines types of information, including Personal Information and Sensitive Information.
Personal Information means information or an opinion about an identified individual or an individual who is reasonably identifiable:
- whether the information or opinion is true or not; and
- whether the information or opinion is recorded in a material form or
If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as “Personal Information” and will not be subject to this privacy policy.
Sensitive Information is defined in the Privacy Act as including information or opinion about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
Sensitive Information will be used by us only:
- for the primary purpose for which it was obtained;
- for a secondary purpose that is directly related to the primary purpose; and
- with your consent or where required or authorised by

- We may collect Personal Information from you whenever you input such information into the Website, related app or provide it to Us in any other way.
- We may also collect cookies from your computer which enable us to tell when you use the Website and also to help customise your Website As a general rule, however, it is not possible to identify you personally from our use of cookies.
- We generally don’t collect Sensitive Information, but when we do, we will comply with the preceding paragraph.
- Where reasonable and practicable we collect your Personal Information from you only. However, sometimes we may be given information from a third party, in cases like this we will take steps to make you aware of the information that was provided by a third party.
- By providing your personal information and identification documents, you consent to us using electronic identity verification services and other third-party verification providers to verify your identity and satisfy our legal and regulatory obligations.
4. Purpose of collection
We are required to comply with applicable anti-money laundering and counter-terrorism financing legislation, including the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), together with any associated rules, regulations and guidance:
- To comply with these obligations, we may:
- verify your identity using government-issued identification documents or electronic verification services;
- collect information regarding the ownership and control of companies, trusts and other entities, including beneficial ownership information;
- conduct sanctions, politically exposed person (PEP) and adverse media screening;
- request information regarding the purpose of a transaction and the source of funds or source of wealth;
- retain identification records and transaction records for the period required by law;
- disclose information to AUSTRAC or other government agencies where required or authorised by law; and
- decline to act or suspend the provision of legal services where we are unable to satisfactorily complete our customer due diligence or where we are prohibited from proceeding under applicable legislation.
- We may disclose your personal information to identity verification providers, credit reporting bodies (where authorised), electronic verification service providers, government agencies, regulators including AUSTRAC, financial institutions, law enforcement agencies and other parties where required or authorised by law, or where reasonably necessary to comply with our AML/CTF obligations.
5. Security, Access and correction
- We retain personal information only for as long as reasonably necessary to fulfil the purposes for which it was collected and to comply with our legal obligations. Where information is collected for AML/CTF compliance, identity verification and customer due diligence purposes, it will be retained for the minimum period required under applicable legislation and regulatory requirements. Once no longer required, we will securely destroy or permanently de-identify the information where permitted by law.
- The Australian Privacy Principles:
- permit you to obtain access to the Personal Information we hold about you in certain circumstances (Australian Privacy Principle 12); and
- allow you to correct inaccurate Personal Information subject to certain exceptions (Australian Privacy Principle 13).

6. Complaint procedure
If you have a complaint concerning the manner in which we maintain the privacy of your Personal Information, please contact us as on the contact details set out at the bottom of this policy. All complaints will be considered by Sheng Lim and we may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.
